Underage Driving Under The Influence (DUI) Laws In Illinois
In Illinois, the state has a Zero-Tolerance DUI law that prohibits drivers below 21 years old from driving with any measurable trace of alcohol or illegal drug in their blood. Minors who have a blood alcohol concentration (BAC) higher than .00% can face a charge.
Underage DUI penalties vary depending on your BAC and prior record, which may include:
- First offense: Three-month driver’s license suspension but may extend to six months for refusing chemical testing
- Second underage DUI offense: One-year license suspension but may extend to two years for refusing chemical testing
- Underage DUI conviction with .08% or higher BAC: Severe fines, potential jail time and a minimum two-year license revocation
Additionally, aggravating factors like high speed, property damage and injuries can significantly increase DUI penalties.
Missouri Underage Driving While Intoxicated (DWI) Laws
In Missouri, a driver under 21 with a BAC of .02% or higher faces administrative license suspension. They can also face criminal DWI charges if determined to be operating a vehicle in an intoxicated condition.
- First offense: 30-day administrative driver’s license suspension then a 60-day restricted driving privilege
- Second offense: One-year license revocation
If alcohol is in the vehicle, you may face an additional Minor in Possession (MIP) charge, which carries up to $300 in fines for a first offense. The municipal courts in St. Charles County that are heavy DWI arrest areas are: City of St. Peters, City of O’Fallon and the City of St. Charles.
How An Under 21 DUI/DWI Charge Can Leave Lasting Impacts
A DUI or DWI charge or conviction in Illinois and Missouri comes with consequences. You may experience rejected applications from colleges and universities. Employment options can be scarce, as employers view alcohol-related offenses as poor judgment and liability.
If you are facing an underage charge in your state, it is advisable to consult an attorney immediately. I can help you navigate and understand the options you may take. As a former prosecutor, I am familiar with how the courts will attack your case.
